Introduction


The issue of proximate cause only arises after the plaintiff has proven that the defendant’s negligence was the cause in fact of the plaintiff’s injury. The doctrine limits liability for the effects of the defendant’s negligence based on a policy determination that the defendant should not automatically be held liable for all the improbable and far reaching consequences of an act.
