Mitigation Of Damages

A plaintiff cannot recover damages for injuries which a reasonably prudent person would have avoided. Usually this only applies to conduct after the accident. Some courts also look to conduct before the accident and will reduce damages because of a plaintiff’s failure to take adequate precautions to reduce potential damages.
