Village of Euclid v. Ambler Realty Co. (S.Ct. 1926)

Facts:

The Village’s zoning law designated certain areas as residential districts and excluded businesses of all sorts from these areas. The value of the Ambler’s land, located in such a district, was substantially diminished.

Issue:

Is a zoning ordinance which creates residential districts, from which all business and trade is excluded, and which therefore may reduce the value of property in such districts, invalid as an unreasonable deprivation of property without Due Process?

Rule:

(Sutherland, J.) A zoning ordinance is unconstitutional only when its provisions are clearly arbitrary and unreasonable, having no substantial relation to the public health, safety, morals or general welfare. An ordinance which establishes residential districts in which all business is excluded is not unreasonable and does benefit the public.
