Guilty Pleas

Under FRE 410, neither withdrawn guilty pleas, nor offers to plead guilty are admissible. Moreover, statements made during plea negotiations are similarly inadmissible. Exceptions:

1.
FRE 410 authorizes the introduction of statements made in connection with plea discussions if another statement made in connection with the plea or offer to plea has been introduced and fairness requires that the fact finder consider the complete statement(s).

2.
FRE 410 makes evidence of withdrawn guilty plea admissible in a prosecution for perjury or false statements.
