Privilege Against Self-Incrimination – Overview

The privilege against self-incrimination is the only privilege mandated by the United States Constitution. In particular, the Fifth Amendment states that no person shall be compelled, in any criminal case, to be a witness against himself. The Fourteenth Amendment Due Process Clause makes this privilege applicable to criminal proceedings in state courts.
