Physician/Psychotherapist-Patient Privilege – Generally

The physician-patient privilege is a statutory privilege that did not exist at common law. Almost every state has enacted a physician-patient privilege. While some states have extended the privilege to cover the psychiatrist-patient relationship, other states have recognized a separate but co-extensive privilege that covers the psychotherapist-patient relationship.
